1. Introduction

Modux, Inc. ("Modux", "we", "us", or "our") operates modux.com. This Privacy Policy explains what data we collect, how we use it, and your rights regarding that data. By using Modux, you agree to the practices described here.

2. Information We Collect

• Account data: name, email address, company name, and password (hashed).
• Usage data: pipeline configurations, execution logs, feature interactions, and in-app events.
• Technical data: IP address, browser type, device identifiers, and referring URLs.
• Payment data: billing address and last-4 card digits. Full card details are processed by Stripe and never stored on our servers.
• Integration credentials: API keys and OAuth tokens you connect to your pipelines, stored AES-256 encrypted.

3. How We Use Your Information

• To provide, operate, and improve the Modux platform.
• To process payments and manage your subscription.
• To send transactional emails (receipts, security alerts, service notices).
• To send product updates and newsletters (you may opt out at any time).
• To comply with legal obligations and enforce our Terms of Service.

4. Data Security

All data is encrypted at rest (AES-256) and in transit (TLS 1.3). We are SOC2 Type II certified. Access to customer data is restricted to authorised personnel on a need-to-know basis and is fully audit-logged. Pipeline execution logs are isolated per account and never shared across tenants.

5. Cookies

We use strictly necessary cookies for authentication and session management, and optional analytics cookies (e.g. PostHog) to understand how users interact with the platform. You can disable analytics cookies via our cookie banner or your browser settings.

6. Third-Party Services

We work with the following sub-processors: Stripe (payments), Amazon Web Services (infrastructure), Datadog (monitoring), and PostHog (product analytics). Each provider processes data only as instructed and is bound by a Data Processing Agreement.

7. Data Retention

We retain your account data for as long as your account is active, plus 90 days after closure to allow recovery. Pipeline execution logs are retained for 30 days (Starter), 90 days (Pro), or custom retention periods (Enterprise). You may request immediate deletion at any time.

8. Your Rights (GDPR / CCPA)

If you are in the EEA, UK, or California, you have the right to: access your personal data, correct inaccuracies, request deletion, restrict processing, and port your data. To exercise any of these rights, email privacy@modux.com. We will respond within 30 days.

1. Acceptance

By accessing or using Modux, you agree to be bound by these Terms of Service. If you are accepting on behalf of a company, you represent that you have the authority to do so. If you do not agree, do not use the service.

2. Service Description

Modux provides a cloud-based AI workflow orchestration platform available on a subscription basis. Features and availability may vary by plan. We reserve the right to modify or discontinue features with reasonable notice.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account.

4. Subscription & Billing

Subscriptions are billed monthly or annually in advance. All fees are in USD and are exclusive of applicable taxes. Prices may be updated with 30 days' written notice. Failure to pay may result in suspension of your account.

5. Refund Policy

• Monthly plans: We do not offer refunds for the current billing period. Upon cancellation, your access continues until the end of the paid period, after which it will not renew.
• Annual plans: You may request a full refund within 14 days of your initial purchase or annual renewal. After 14 days, no refunds are issued for the remaining term.
• Service credits: If Modux fails to meet its 99.9% monthly uptime SLA, you may be eligible for service credits as documented in our SLA policy. Credits are applied to your next invoice and are not redeemable for cash.

To request a refund, contact us at billing@modux.com with your account email and a brief reason. Refunds are processed within 5–10 business days to your original payment method.

6. Chargeback Policy

We take billing disputes seriously and are committed to resolving them fairly. Before initiating a chargeback with your bank or card issuer, please contact us first at billing@modux.com. Most billing issues can be resolved quickly and informally.

Initiating a chargeback without first contacting us may result in immediate account suspension pending investigation. We reserve the right to contest any chargeback we believe is unwarranted, including submitting transaction records, usage logs, and correspondence to your financial institution. Accounts with upheld fraudulent chargebacks may be permanently banned from the platform.

7. Acceptable Use

You may not use Modux to build pipelines that generate spam, conduct phishing or fraud, violate applicable laws, or infringe third-party intellectual property rights. We reserve the right to suspend or terminate accounts in violation of this policy without notice.

8. Intellectual Property

Modux and its underlying technology are owned by Modux, Inc. You retain all rights to your data and pipeline configurations. By using Modux, you grant us a limited, non-exclusive licence to process your data solely to deliver the service.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Modux's total liability to you for any claim arising out of or related to these Terms or the service is limited to the fees you paid in the three months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately for material breach of these Terms, non-payment, or conduct that we determine poses a risk to the platform or other users.

11. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions. Any disputes shall be resolved exclusively in courts located in San Francisco, California.

Free Trial

Monthly Subscriptions

Monthly subscriptions are billed in advance and are non-refundable for the current billing period. If you cancel a monthly plan, your account remains active until the end of the billing cycle and will not renew thereafter. No partial-month refunds are issued.

Annual Subscriptions

Annual subscriptions are eligible for a full refund within 14 days of the initial purchase or annual renewal date. After the 14-day window, the subscription is non-refundable for the remainder of the annual term. Cancellation after 14 days will prevent the next renewal but will not generate a refund for the current period.

Service Credits

If Modux fails to meet its 99.9% monthly uptime SLA, affected customers may request service credits equal to the value of the downtime period. Credits are applied to the next invoice and are not redeemable for cash. Credit requests must be submitted within 30 days of the incident.

How to Request a Refund

• Email billing@modux.com from the address associated with your account.
• Include your account email, the subscription type, and a brief reason for the request.
• Eligible refunds are processed within 5–10 business days to your original payment method.

Chargeback Policy

We are committed to resolving all billing issues fairly and promptly. Please contact us at billing@modux.com before filing a chargeback. Chargebacks filed without prior contact may result in immediate account suspension while we investigate.

We reserve the right to contest chargebacks we determine to be unwarranted. In such cases, we will provide your bank with relevant evidence including transaction records, login activity, and any prior correspondence. Accounts found to have submitted fraudulent chargebacks may be permanently suspended and reported to payment processors.

If you believe you have been charged in error, we want to make it right — please reach out and we will resolve it quickly.
